These Terms and Conditions (“Terms”) govern the use of Rebel Boom’s crowdfunding platform (“Platform”) for the purpose of receiving donations or contributions from individuals or entities located outside of the United States. By donating or contributing to any campaign on Rebel Boom’s Platform, you (“Donor”) agree to comply with and be bound by these Terms.
By making a donation or contribution to Rebel Boom, you affirm that you have read, understood, and agree to be bound by these Terms and any other relevant policies or guidelines incorporated herein by reference. If you do not agree with these Terms, you should not make any donations or contributions.
2.1. Age Requirement: Donors must be at least 18 years of age or the age of majority in their jurisdiction of residence, whichever is older.
2.2. Legal Authority: By making a donation, you represent and warrant that you have the legal capacity to enter into a binding contract with Rebel Boom under the laws of your country or territory of residence.
3.1. International Regulations: Donors from outside the United States must comply with all applicable laws and regulations in their country or territory of residence, including but not limited to, anti-money laundering laws, anti-terrorism financing laws, tax laws, and data protection laws.
3.2. Sanctioned Countries and Prohibited Donors: Rebel Boom does not accept donations from individuals or entities located in, or residents of, countries or territories that are subject to comprehensive U.S. sanctions, including but not limited to, Cuba, Iran, North Korea, Syria, and the Crimea region. Furthermore, Rebel Boom does not accept donations from any person or entity that is on the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List (SDN List).
4.1. Currency and Payment Methods: Donations made to Rebel Boom from international territories must be in U.S. Dollars (USD) unless otherwise stated. Rebel Boom accepts payment via major credit and debit cards, and other payment methods as specified on the Platform.
4.2. Currency Conversion Fees: Donors acknowledge that they may be subject to additional fees, such as currency conversion fees, foreign transaction fees, or other bank fees. Rebel Boom is not responsible for any such fees incurred by the Donor.
5.1. Refund Policy: All donations made to Rebel Boom are final and non-refundable, except in cases where Rebel Boom, at its sole discretion, determines that a refund is warranted due to error, fraud, or other exceptional circumstances.
5.1 (a) Campaigns Not Reaching Their Funding Goals: In the event a campaign does reach its funding goals, all donations will be returned to their international contributors/donors in accordance to the USD / international currency / territory exchange rate at the time of issuing the refund.
5.2. Chargebacks: In the event of a chargeback, Rebel Boom reserves the right to recover any funds that were refunded by the payment processor, and the Donor may be liable for all associated fees, including legal fees, collection costs, and penalties.
6.1. Responsibility for Taxes: Donors are solely responsible for determining and complying with any tax obligations applicable to their donations in their country or territory of residence. Rebel Boom does not provide tax advice and recommends that Donors consult with a tax professional regarding their specific circumstances.
6.2. Tax Deductibility: Donations made to Rebel Boom are not tax-deductible in any jurisdiction unless explicitly stated otherwise. Rebel Boom does not guarantee the tax-deductible status of any donation made through its Platform.
7.1. Data Collection and Usage: By making a donation, Donors consent to the collection, use, and processing of their personal data in accordance with Rebel Boom's Privacy Policy. Rebel Boom will take reasonable steps to protect Donor data from unauthorized access, disclosure, or misuse.
7.2. Cross-Border Data Transfers: Donors acknowledge and agree that their personal data may be transferred to and processed in the United States, which may have different data protection laws than the laws of the Donor's country of residence.
8.1. No Liability for Losses: To the fullest extent permitted by law, Rebel Boom, its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform or the making of a donation.
8.2. Indemnification: Donors agree to indemnify, defend, and hold harmless Rebel Boom from and against any and all claims, losses, liabilities, damages, costs, or expenses, including reasonable attorney fees, arising out of or related to their donation or violation of these Terms.
9.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of [State], United States, without regard to its conflict of law principles.
9.2. Jurisdiction: Any disputes arising under or in connection with these Terms shall be resolved in the federal or state courts located in [City], [State], United States. Donors hereby consent to the exclusive jurisdiction and venue of such courts.
Rebel Boom reserves the right to amend these Terms at any time. Donors are encouraged to review these Terms periodically for any changes. Continued use of the Platform after any amendments constitutes acceptance of the new Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
